Description

New Jersey application season has (finally) arrived! On December 15, 2021, NJ issued a Notice of Application Acceptance for Cultivation, Processing, and Laboratory Testing. On March 15, the window will open for Retail. Meanwhile, the NJ Cannabis Regulatory Commission is working on regulations for Delivery, Distribution, and Social Use, with applications for those licenses expected soon(ish). New Jersey’s regulations present a web of unique priorities, restrictions, and limitations on the types and number of licenses and financial interests that individuals and entities may own – all designed in an effort to support small businesses, social equity candidates, and diversely held businesses, and prevent predatory actions by more resourced operators.

In this session, hear from attorneys who are actively working on applications in the Garden State and with clients who are investing in New Jersey or otherwise gearing up for future submissions. Learn about unique-to-New Jersey license types, such as the “Conditional License,” enabling prospective operators to apply for a license without site control (subject to income restrictions), the “Micro-license,” a 2500 square foot facility for which there are no caps (subject to residency requirements), priorities in licensing, and creative opportunities to participate in the market distinct from ownership (via “Financial Source Agreement” or “Management Services Agreement”). Also learn about how the regulatory process is unfolding and how administrative delays are impacting the licensing process and accompanying operational timelines and legal transactions. If anything is certain, the roll out has not been a smooth sail, but attorneys – serving as gatekeepers to the process – are nonetheless optimistic that New Jersey’s ultimate market will be robust and diverse.

General

This program is eligible for 1 hours of General CLE credit in 60-minute states, and 1.2 hours of General CLE credit in 50-minute states. Credit hours are estimated and are subject to each state’s approval and credit rounding rules. 

INCBA webinars are generally eligible for credit in the following states: AR, AL, CA, CO, GA, HI, IL, NJ, NM, NY, ND, PA, TX, VT. Additional states may be available for credit upon self-application by attendees. States typically decide whether a program qualifies for MCLE credit in their jurisdiction 4-8 weeks after the program application is submitted. Bill serves as Chair of Archer’s Cannabis Group. Bill is one of the leading advocates and influencers for the cannabis industry, and served as an influential voice in New Jersey’s long battle to end cannabis prohibition. He is a co-founder of New Jersey United for Marijuana Reform, a group that laid the groundwork for the legalization movement. Bill was also a leader with the advocacy group, NJ CAN 2020, that spearheaded the November 2020 ballot initiative to legalize cannabis for personal use.

In his practice, Bill represents clients that are both veterans and new leaders in the medical and adult-use cannabis industries, including retailers, processors, growers and ancillary businesses. He provides guidance on marijuana-related business issues, including issues pertaining to strategic planning and transactions, banking and finance, taxation, labor and employment, land use and zoning, real estate, municipal law, and healthcare law.

Bill has a deep knowledge of New Jersey government and strong relationships with political and industry leaders in the state. Prior to joining Archer, Bill served nearly five years as the Executive Director of the New Jersey Assembly Majority Office in Trenton. He was responsible for developing and implementing the Assembly’s policy agenda, and, as top aide to the Speaker, served as lead staff negotiator on all policy matters and as liaison to the Governor’s office, Senate and state departments. He was responsible for daily management of approximately 30 policy research professionals and communications and administrative staff.
