Description

What happens when a movement becomes an industry? We’ll identify the spectrum of legalization – the many forms, and reasons that lead to commercial, regulated marijuana and industrial hemp industries around the world. While there are advantages and disadvantages to different regulatory frameworks, ultimately there are four distinct policy lanes that serve as the common denominator for supply chain and global commerce. We’ll cover where the power to regulate/enforce gets vested, and through which agency/agencies, how cannabis becomes legalized: whether through legislation, ballot measures, or litigation, and the COVID Impact: what an  “essential” designation means for cannabis as a driver of international economic development.

General

This program is eligible for 1 hours of General CLE credit in 60-minute states, and 1.2 hours of General CLE credit in 50-minute states. Credit hours are estimated and are subject to each state’s approval and credit rounding rules. 

INCBA webinars are generally eligible for credit in the following states: AR, AL, CA, CO, GA, HI, IL, NJ, NM, NY, ND, PA, TX, VT. Additional states may be available for credit upon self-application by attendees. States typically decide whether a program qualifies for MCLE credit in their jurisdiction 4-8 weeks after the program application is submitted. For many live events, credit approval is not received prior to the program.

Tamar Todd is an experienced attorney with expertise in policy advocacy, legislative drafting, statewide political campaign strategy, regulatory implementation, and non-profit management in the areas of drug law reform, cannabis law and policy, public health, and criminal justice. She is the former legal director of the Drug Policy Alliance, where she was responsible for developing and overseeing the organization’s legal work as it related to legislative drafting, policy advocacy, litigation, and public education in local, state and federal jurisdictions. She has a particular expertise in marijuana decriminalization, legalization, and regulation, and she co-authored several state and local ballot initiatives and statutes, including Amendment 64 in Colorado and Proposition 64 in California. She has advised the governments internationally on their efforts to legalize the production and distribution of marijuana, and she has testified in numerous legislative and government bodies in the United States and abroad on the issue of drug policy and the intersection of state and federal law. She serves as Vice-Chair of the California Cannabis Advisory Committee, which advises the California Bureau of Cannabis Control on the implementation of California’s marijuana legalization law.

 

Todd received her B.A. from the University of Vermont and her J.D. from the Georgetown University Law Center. After law school, she clerked for the Hon. Emmet Sullivan on the U.S. District Court for the District of Columbia, and she spent several years representing death row inmates as a staff attorney with the Southern Center for Human Rights in Atlanta.

Carlos Allan Malacara is a senior associate at “Panamericana de Patentes y Marcas” (Mexico) and has been closely following Mexico’s progress towards the authorization of medical and recreational use of cannabis, which started around 4 years ago. He is well versed in the legal aspects that revolve around the plant’s legality and regulation in the country.

 

His practice began in 2009 and focuses on Intellectual Property, with expertise in the automotive, chemical, life sciences, pharmaceutical, consumer goods, fashion, gaming, sports and technology industries, providing strategic trademark counseling to domestic and international clients including pre-filing stages, trademark clearance and classification of goods / services, specializing in prosecution, enforcement, litigation and dispute resolution proceedings.

 

Mr. Malacara co-launched last year the cannabis Law practice at “Panamericana de Patentes y Marcas” to support the needs of the industry in Mexico.
